Subscription T&Cs

The website (hereinafter referred to as " OZERTY ") is published at https://ozerty.it.

ARTICLE 1 : Definitions

To facilitate the readability of these Terms and Conditions of Subscription, the following terms will always have the meaning and scope given to them in this article.

Terms	Definitions
T&Cs	Refers to these Subscription Terms and Conditions.
User Account	It refers to the User's personal account whose registration is necessary for the use of the Service and which he can access on the site using his credentials to consult and manage a set of information concerning him on the website, in particular his personal data, the history of his purchases made on the website, his delivery addresses, etc.
Credentials	Refers to the username and password chosen by the User and which allow him to access his User Account to access all or part of the Service.
Registration	Refers to the online registration procedure on the website that the User must complete to use all or part of the Service, and which gives rise to the creation of the credentials and the User Account.
Service Costs	Refers to the costs of the Service subscribed to by the user, including, for example, but not limited to: delivery costs, product customization costs when offered, etc.
Service	Refers to the service offered on the website by OZERTY for the conclusion of one or more subscriptions via the site.
Site	Refers to the website https://ozerty.it which allows you to view current consumer goods and purchase them and receive your purchases.
User	Refers to any adult or legal person registered on the Site and subscribing to the Service, if applicable.
Visitor	Refers to any natural or legal person who accesses the Site for consultation purposes and who does not have a User Account.
Subscription	This refers to the subscription program offered by Ozerty.
Subscriber	Refers to any user who has subscribed to the service.
Ozerty No Limit	This refers to the name of the subscription program offered by Ozerty.

ARTICLE 2: Acceptance of the terms and conditions of use

These T & Cs regulate the access of Users to the Subscribed Service offered on the Site (Ozerty No Limit). Subscribing to the service implies acceptance of the Terms and Conditions of Use of the Service described here.

Any registration and/or subscription to free or paid Services, as the case may be, implies the unreserved acceptance by the User of the provisions of the T & Cs which he expressly declares to have previously read, understood and accepted.

Subscription occurs via a checkbox when the User makes a purchase for the first time (“Subscribe to Ozerty No Limit”).

The current version of the T&Cs is available at any time and freely accessible on the Site. OZERTY may modify the T&Cs at any time depending on certain technical, economic, legal or commercial restrictions, such as the launch of new services.

Users are informed of changes to the T&Cs within a reasonable time. If applicable, they are informed when they access the new T&Cs in force and must accept them to continue to benefit from the Services.

Otherwise, the User may cancel the subscription, such cancellation taking effect upon receipt of the User's last order for any orders placed prior to the modification of the T&Cs.

Any derogation from the T&Cs, to be valid and binding for OZERTY, must be the subject of a written agreement, signed by OZERTY.

Any condition opposed by the User will therefore be, in the absence of express acceptance, inapplicable to OZERTY, regardless of the time at which it is brought to its attention.

ARTICLE 3: Object of the subscription

The Ozerty No Limit subscription allows the subscriber to benefit from unlimited deliveries without a minimum purchase for 1 year.

The Ozerty No Limit service subscription is valid only on the OZERTY website and cannot be applied to other sites.

ARTICLE 4: Price and payment terms

The subscription price is €29.99 every 4 months, including all costs.

The subscription is without obligation and can be cancelled at any time without any fee, unless the benefits of the subscription have already been used by the subscriber.

Shipping costs are charged once per order. If the subscriber wishes to receive his items in multiple shipments, shipping costs will be charged for each subsequent shipment.

Payment for the subscription is made annually. A notification email is sent to the subscriber before each charge. No monthly payments are allowed. Payment can be made by credit card or PayPal. Payment is automatically charged at the end of the subscription year, unless the subscriber cancels the subscription in accordance with article 6 of these T & Cs.

ARTICLE 5 : Period of validity

The subscription is valid for 1 year from the date of subscription, unless cancelled by the subscriber before the end of this period.

ARTICLE 6 : Cancellation

The subscription is a service without obligation. It can be interrupted at any time. The subscriber can request the cancellation of the subscription at any time by requesting cancellation via email to contatto@ozerty.it.

If less than 30 days have passed between the last charge and the cancellation request and the subscriber has not used any of his benefits, he can request a full refund of the last payment.

If any service is used within the first 30 days, the first month is used up and cannot be refunded, but only the remaining period of the month can be refunded.

After the first 30 days, the subscriber can request a refund for the remaining period of the subscription. Each month started is an expiration month and cannot be refunded. For example, if after 33 days the subscriber wants to stop the subscription, he can request a refund of €0.25 x 87 days: €21.75.

If a cancellation request is received via email, any new payments that may occur after the date will be automatically refunded.

All refunds will be processed within a maximum of 14 working days.

ARTICLE 7 : Modifications to the T&Cs

OZERTY reserves the right to change these conditions at any time. Any changes will be notified at least 30 days in advance before they come into effect, to the subscriber. If the subscriber does not accept the new T & Cs, he can request the cancellation of the subscription by following the procedure above.

ARTICLE 8: Limits of liability

The Service is provided on an "as is" and "as available" basis without any warranties.

OZERTY cannot be held responsible for the unavailability of a product, or if the purchased product does not meet the subscriber's expectations.

ARTICLE 9: Personal data

By subscribing to Ozerty No Limit, the subscriber agrees to OZERTY's use of personal data in accordance with the site's privacy policy.

ARTICLE 10: Applicable law

These T&Cs are governed by Italian law.

Any complaint must be sent within a maximum of thirty (30) days from the date of execution or the expected date of execution of the Service subscribed by the subscriber to the following address:

In the absence of an amicable resolution of a dispute between the parties, the Italian courts shall have exclusive jurisdiction to hear it.
